Caro Collega,

continuo imperterrito la mia battaglia contro il MIT da anni, anche quando in molti mi dissuadevano dal farlo.

Oggi ho ottenuto un’importante riscontro dalla commissione europea.

Lo giro a te, di modo che chiunque possa far valere l’opinione della Commissione Europea nella sede più opportuna e con i mezzi che riteni più idonei.

In pratica sostengono l’assurdità con profondo dissenso e l’inammissibilità della politica del MIT (leggere la parte in grassetto).

Questo elemento è da portare in sede giudiziaria.

In bocca al lupo e non mollate, perchè chi parte già avvilito e si aspetta qualcosa dagli altri ha gia perso.

Muovetevi tutti e facciamo tutti la nostra parte.

Art . 19.1 of the Italian Legislation D.L. n.71/2015 (transposition of 2012/35/UE which modifies 2008/106/CE) provides that the certificate of competence and the certificates of training issued according to the procedures provided by the STCW Convention by one of the Member States are subject to recognition by the Italian administration. The recognition is granted only upon the evaluation of the conformity of the certificates to the requirements provided by the STCW Convention.
As the certificates issued according to the Convention are different in the Member Statesi it is necessary that the Italian administration recognize them only upon verifying this conformity, avoiding further administrative requirements which would be burdensome.
Nonetheless, art. 19.4 provides that Ministry of Infrastructure and Transport in the recognition decree can set further limitations on the capabilities, functions and levels of competence on coastal voyages, in accordance with Article 8, or provided for the possession of alternative certificates.

The grounds on which the recognition was refused : ONLY THE CERTIFICATES ISSUED BY THE TRAINING CENTERS BASED IN THE ITALIAN TERRITORY AND RECOGNIZED BY THE MIT (Ministry of Infrastructures and Transportation) ARE VALID , seems anyway discrimininatory and an unjustified rescrtiction on the free circulation of maritime workers within the EU.
