Instructions to Prospective chartering service providers
Dear Italian Yacht Masters

After 45 days,we finally have an official list of documents that Ministry of sea require to obtain the charter/cabotage licence.
In the attachment you will find official documentation(translated in English by official Lloyd translator in city of Rijeka) and a brief overview of documents that you require.

The news is that the Ministry made a limited number of cabotage licences for NON EU flag(over 40m L.O.A.) and limited number of licences is 159 .My personal opinion is that will be very hard to exceed that number.

Private Yachts EU or NON EU Flag registered under owners name&surname(NO CHARTER USE):
These type of yacht will be able to embark and disembark unlimited number of guests during their stay in Croatia.
Captain will need to have notarized ”Power of attorney” from the owner of the yacht,so he can act in the name of the owner during yacht stay in Croatia.Please note that ”Power of attorney need to have duration period(from-to),the Harbor Master office will not consider ”Power of attorney” without duration period.Captain/Owner will need to have updated crew and passenger list all the time,signed and stamped by Captain/Owner.

Private Yachts EU or NON EU Flag registered under Company name(NO CHARTER USE):
These type of yacht will be able to embark and disembark unlimited number of guests during their stay in Croatia.
Captain will need to have the list of persons who Company authorized to use the yacht.
We asked the Ministry to allow the Captain to update this list whenever is necessary(without going to the notary),and they promised us that they will allow it.
Please note that ”Power of attorney needs to have duration period(from-to),the Harbor Master office will not consider ”Power of attorney” without duration period.Captain will need to have updated crew and passenger list all the time,signed and stamped by him.

Commercial Yacht NON EU Flag under 40 m L.O.A.
These type of yacht will not be able to embark guests in Croatia,they need to be embarked outside Croatia.
Company needs to send to the Captain the ”Power of attorney”as explained above

Commercial Yacht NON EU Flag over 40 m L.O.A.
These type of yachts will be able to embark and disembark guests during their stay in Croatia under this regulation:Official Company representative in Croatia or authorized maritime agent(like Simmor) can arrange cabotage permit for Croatia(needs to be started A..S.A.P. because procedure will take more then 30 days).Company will need to pay the 13%VAT on the Charter contract.If the Charter is starting outside Croatia,there will be no VAT.
Company needs to send to the Captain the ”Power of attorney” as explained above.

These are some answers to the questions you will mite ask me:

Who will be paying the VAT and to whom?
Owning company who signed the Charter contract will be paying the VAT to the Ministry of Finance of Republic of Croatia.(yet to be defined the details)

Why NON EU flags Yachts under 40m will not be able to embark in Croatia?
With this regulation Croatia is trying to protect Croatian Charter yachts who are all under 40m.

Why 13% VAT?
Croatia have 3 types of VAT,0%,13% and 25%.They decided 13%,because this is the VAT that Croatian charter yachts are paying for their charter contracts.

Will Yachts have tax free fuel and food?
Not yet,but we are working on it.

Will VAT be applied on full Charter contract amount or it will be calculated just for the days that charter was in Croatia?(when embark is in Croatia)
Unfortunately,it will be applied on full amount.

Some very important information:

-Our custom office will be checking all the Charter contracts by going to the Charter broker web site and checking if the price of the charter advertised on web is the same like in the contract.They will tolerate +/- 5%.This is so stupid idea,and we told them,but…

-This season we will not have Vinjeta(Navigational permit) any more.
Our new Navigational permit will be called ”Safety Sailing and Pollution protection fee”and it will be valid 365 days.
Calculation of the fee:
-If the yacht is more then 40 m L.O.A. or over 3000 kW engine power,price will be 7,500 kuna(around 1000 Euro)
-If the yacht is less then 40m L.O.A. or less then 3000 kW engine power we will use this formula:20xL.O.A.+2xKW=price in kuna
Example:20x39m+2x2900kw=780+5800=6580 kuna(about 877,33 Euro)

Tourist tax will be the same:month 1000kuna,three months 1300 kuna,one year 1700 kuna(exchange rate :1 Euro=7,50 kuna)

If the yacht still have valid old Nav permit,it will stay valid until duration date.
